How much does it cost to employ a solicitor in Scotland to defend a motoring charge?
I've been charged with using a mobile phone while driving in Ardrossan, Ayrshire late April 2010. Only problem is - I hadn't been. I wish to god I had been, because I would have just paid the �60 quid fixed penalty and took it on the chin without a problem. But because I am innocent I told the 2 police to stuff their fixed penalty and take me to court and I declined to take the ticket. But when I got home and googled, I soon got pretty worried. It seems that there have been a few similar cases which motorists have fought and won - but at a cost of anything up to �2500. I just can't afford this and I don;t qualify for Legal Aid because I own my house. I've blown any chance of only having to pay the �60 fixed charge by refusing the original ticket. I'm contemplating just accepting the next level of fine, but does anyone know - does that mean I have to plead guilty? That WOULD be sore. And how much is the next level fine likely to be? Can anyone give me an idea of how much it would cost me to hire a solicitor to defend against this charge? And if I win will the costs be reimbursed to me? This would be Scots law only. Thanks.
